MISSOULA – A motion to suppress evidence in the criminal case against Autumn Siena Heinz has been granted by Judge Robert Deschamps III.
Heinz is facing three counts of felony charges after police produced evidence that she had been smoking meth in a YMCA daycare facility.
Missoula Police responded to a report of drug activity at the daycare facility by another daycare employee and the director of the facility.
When police arrived they questioned Heinz and ask to search her bag for weapons and contraband before they took her to the police station for more questioning.
Police read Heinz the Miranda warning before questioning her at the police station but failed to do so before interviewing her at the daycare facility or searching her bag.
Judge Deschamps ruled that any evidence from the search or interview at the daycare facility will be suppressed in the case.
All of the evidence found after a warrant was issued will be allowed in court and anything said by Heinz after she was read her Miranda rights will also be allowed.
