Judge rules in favor of Flora in Turk road easement

HELENA – A Helena judge has ruled that a couple has the right to access their property across a disputed portion of Turk Road, northwest of Helena.

Marc and Gloria Flora argued they have a legal easement to cross 60 feet of Turk Road as it passes through the properties of Katie Wessel and John Mehan, and Dennis Shaw and Linda Koontz.

However, Wessel and Mehan claimed that because their deed does not detail the easement, the Floras don’t have a right to cross the property.

But according to court documents, the Floras presented a chain evidence from the 1970’s to the 2000’s that detail the easements allowing other property owners in the area to use that road to access their properties.

This is not the only Turk Road property dispute Katie Wessel and John Mehan have been involved in.

Mehan and Wessel were in a long-running dispute with Mike Crites, who was found murdered on MacDonald Pass in 2011.

A year’s-long lawsuit involving Dennis Shaw, John Mehan and Katie Wessel and the Crites estate is yet to be settled.

No one has been charged in Mike Crites’ death.
